Dear Ms. Kenny:
Our organization was created early this year to oppose the construction of a marina in Dorado, Puerto Rico (La Cala Turistica de Dorado) by developer Federico Stubbe and Hyatt Hotels Corporation. We believe it would damage, among other things, existing wetlands as well as aquifers, which supply water for much of the island’s north coast. The enclosed article mentioning an EPA crackdown on Suchville Development, Inc. for illegally constructing an apartment complex on wetlands, is of great interest to us. The following may be of interest to you as well. Next to that development is the now-closed Hyatt Cerromar Hotel, where in 2001, Hyatt and Mr. Stubbe were prevented from completing a road and luxury villas on those same wetlands between the Cerromar and Lakeside Villas. Before construction was halted, the road was completed. Plans to move the villas to a different location are in progress.
The proposed marina would be at the opposite end of the hotel’s 1,000 acres, in front of their other Dorado hotel, the Dorado Beach. This site is our main focus and we mention only the two issues (of many) which we hope will result in an investigation by the EPA. Mr. Stubbe is also now building a development called La Sabanera nearby, apparently destroying not only wetlands next to the site of the hotels’ former airport but “magotes,” (hills), also protected by law. We’re told dirt from the magotes is being used to fill in the wetlands. Much of La Sabanera is in a flood plain and is close to a dump, which was closed some years ago when it reached its maximum height.
We have not contacted the EPA in San Juan since we have reason to believe there is a conflict of interest between that agency and Mr. Stubbe’s organization.
We hope your office will find this information worthy of an investigation.

Save Our Beach (S.O.B.), Inc. Founders’ Message
We hope you will enjoy the first newsletter of Save Our Beach, (S.O.B.) Inc., “Sin Arena!” Our organization was given its name early in 2003 after a year of gathering information to oppose the marina project of Hyatt Hotels and developer Federico Stubbe, La Cala Turistica de Dorado. In February we began submitting reports and intervention letters to federal and Commonwealth agencies. We watched for an opportunity to inform and involve the public to prevent the environmental disaster as well as to avoid the loss of the beach to the public.
With the year 2000 zoning changes that made the entire coastline from Vega Alta almost to Catano a Tourist/Commercial Zone (the highest possible density, including marinas), we are in danger of losing all those miles of pristine beaches to luxury resorts and housing.
It was Carlos Weber of Channel 11 who took our information and presented a three-part series on May 26 – 28 that exposed the project to public scrutiny. This was followed by a beach rally on June 2, our first community outreach. We want to thank everyone who has been involved since that time in stopping this atrocity.
There will soon be two public hearings, one by the Environmental Quality Board (EQB) and one by the Planning Board. When that happens we will need your help to protest with us at these hearings. Please join us then to stop this project which would change forever the character of our beloved Dorado. We believe La Cala is the linchpin of a land grab designed to make the whole coast of our town, including the urbanizations of Costa de Oro and Mayeyal, conform to the new zoning. We will let you know when and where in plenty of time.

ENVIRONMENT: The complex of physical, chemical and biotic factors (as climate, soil and living things) that act upon an organism or an ECOLOGICAL COMMUNITY and ultimately determine its form and survival. (Merriam Webster Collegiate Dictionary)
Ideally, man should be a cooperating participant in the seamless tapestry of life, being responsible stewards of their earthly blessings. But, especially since the advent of dynamite and other powers homo sapiens have discovered on their evolutionary march, disruption and destruction are frequent consequences. Nowhere is this more evident than on the island of Puerto Rico where a consortium of politicians and developers are continuing their assault on the environment, always in the name of economic growth (and the unspoken profit motive). No part of the island is safe from their depredations. In Dorado, La Cala Turistica de Dorado, submitted to the Planning Board by the government’s Tourism Company in March, is a classic example of such an atrocity. The same thing is happening in Fajardo and Luquillo, with many activists doing all they can to prevent them there. Audaciously proposing a gargantuan marina for megayachts on the north (Atlantic Ocean) coast, Hyatt Hotels Corporation and developer Federico Stubbe would have you believe no harm would be done to: endangered species habitats (Hawksbill and Leatherback turtles, the manatee) and their food sources; the sand, which has been eroding for years; aquifers supplying water to neighboring communities; wetlands and the Pterocarpus Forest; fragile coral reefs; and, the public beach, our patrimony for over five hundred years.
Ecologists may not need help from others but those of us trying to protect the natural balance of things in our community certainly do.

“……..The ocean in Dorado is being threatened by the
project of a developer named Federico Stubbe in
conjunction with the Hyatt Hotel Corporation to build
a marina that would accommodate 125 boats, including
ocean-going yachts. This marina would be a five-acre
site dug 16 feet into the ocean floor as well as a man-
made lagoon onshore within the Dorado Beach Hotel
golf course of another five acres to be a turnaround
for the yachts as well as 20 private homes and 150
villas with private yacht slips.
The largest of these yachts, 80 feet or more, would
have a draft of approximately 7 feet. This would
require blasting a channel through the offshore reef and
and sea grasses, eliminating the thriving undersea life.
What of the unintended consequences, such as have
occured at the nearby Embassy Suites Hotel in
Dorado, which opened in September, 2001? Here
the developer, Cloefe Rubi, was allowed to blast a
swimming beach out of the coral in front of the hotel.
into which he put a great deal of sand. Not only is
the sand gone but so is the wildlife (some endangered)
and the turtle grasses. This has resulted in a mudhole
bottom, two large channels leading into the public
beach and flooding in a nearby neighborhood with
turtles, fish and other creatures floating about in
people’s yards. We were told there was some sort of a
tradeoff (the new word is ‘mitigation?’) with another
developer further down the coast that allowed the
project to proceed.
We believe this is an example of the corruption of the
permitting process.”

Here Are a Few Quotes from the Book
PP. 11 – 13. Winter storms, such as the 1992 “Perfect Storm.” of movie fame, “The winter storm season brings additional perils…..Such storms may be stationary for several days, generating gigantic waves. These waves actually outrank hurricane waves in terms of the wave size impacting the north coast. Homes and neighborhoods can be flooded, beaches are eroded, and roads are overwashed as a result.” For those living in Costa de Oro or Dorado del Mar, Dorado, during that windless and rainless storm, the waves were about 20 stories high and took down some buildings on the public beach. The tides were in the street and sand remained there for days.

Tsunamis, sometimes called tidal waves (or seismic sea waves), are waves produced by earthquakes, submarine volcanic explosions, or large submarine landslides….Tsunamis travel at more than 640 kms. per hour…Numerous tsunamis have hit the coast of Puerto Rico….Given that a tsunami can strike virtually any part of the coast, this hazard is one more reason why coastal construction sites should be selected with a concern for safety.”

Although the wire is coated with plastic, the mesh inevitably rusts, the rocks spill out, and the wall disappears…The rock strewn over the beach are a nuisance to beach strollers.” There is no swimming area in front of the gabion and the sand filled in behind it is already being eroded. Sardinara Beach also has a small breakwater and two jetties in this area which have little to ameliorate the problem. This book also points out that the nearby paved boat ramp has increased erosion because it, “blocks the westward traveling sand.” (P. 123)

Do you know about the proposed law that would require DNER to change its regulation of "public beach," now stating that the public beach runs from the ocean to the hurricane high tide, to "the average distance from the ocean to the vegetation area during the last 19 years."? This, of course, will eviscerate the regulation and enable developers, who are chafing under the strong prohibitions currently in place, to do pretty much as they please. Stubbe/Hyatt have already asked for an exemption to that reg for the marina they're planning for the Dorado Beach Hotel golf course area.Our lawyer, Lic. Pedro Saade, will be filing an injunction against it. and then we're off to the races, as they say. I'm told news of the proposed law appeared in the two local Spanish language papers last week but not in the Star. Could you get that, do you think, and put it on the site? I did see one DNER reg there from 1972 but not the current one from 1999. Save Our Beach (S.O.B.), (Salvemos Nuestra Playa) has been working for more than a year to stop La Cala Turistica and will soon need support from other groups. ************************************

Los controvertidos proyectos Brighton Country Club y Plaza Dorada de Dorado, alegadamente construidos de forma irregular sin permisos de la Administración de Reglamentos y Permisos (ARPE), terminaron en el tribunal la semana pasada, en uno de los primeros casos que lleva el ex presidente del Tribunal Supremo, José A. Andreu García, tras retirarse del alto foro y regresar a la práctica privada.
Andreu radicó junto al Lcdo. Juan A. Marchand Quintero un recurso de mandamus contra ARPE, pidiendo al tribunal que ordene a la agencia que resuelva la solicitud de intervención en ambos casos radicada por la sucesión de José Efrón, dueña del terreno colindante a ambos desarrollos.
La misma agencia ya ha determinado que en el caso de Brighton prácticamente se construyeron unas 58 residencias antes de tener permiso de ARPE, y a pesar de una orden de paralización del Departamento de Recursos Naturales y Ambientales (DRNA).
Aunque Brighton y Plaza Dorada son componentes distintos del proyecto, las obras de urbanización son comunes para el proyecto en su totalidad, incluyendo los trabajos para manejar la escorrentía de las aguas de superficie: un asunto que el proyectista resolvió construyendo dos tuberías que echan esas aguas a los terrenos de la sucesión Efrón, sin autorización de la sucesión ni permiso del DRNA.
Esa agencia paralizó la construcción de las tuberías en 2001, pero al año siguiente el desarrollador instaló dos tubos de 36 pulgadas de diámetro y 200 metros de longitud para desaguar unos humedales en el proyecto, sin solicitar permiso para ello. El DRNA ordenó paralizar las obras de drenaje y radicó una querella formal contra Brighton, solicitando multas de $250,000. Ese proceso está pendiente de adjudicación.
El 20 de junio de 2003, mientras tanto, ARPE consignó que Brighton no tenía endosos agenciales para una charca de retención y las obras pluviales del proyecto, que "se llevan a cabo obras de construcción… sin la correspondiente autorización o permiso de la ARPE", en violación a la ley y a los reglamentos 3 y 12 de planificación.
Según el recurso de mandamus, tanto el proyecto residencial como el comercial de Plaza Dorada han continuado adelante a pesar de las órdenes de paralización y el hecho de que aún no se han resuelto las querellas ante ARPE y el DRNA.
Aunque ARPE no ha resuelto la solicitud de intervención, tampoco le ha notificado a la sucesión de reuniones y vistas administrativas sobre ambos proyectos. Sin embargo, alega la petición de mandamus, el consultor de Brighton y Plaza Dorada, Camilo Almeida, admitió en una carta del 22 de diciembre de 2003 que él sí "se ha reunido ex parte con altos funcionarios de ARPE", reuniones que no le fueron notificadas a la sucesión y que no aparecen registradas en el expediente del caso.
Al 9 de marzo de 2004, ARPE no había adjudicado ninguno de los anteproyectos de Brighton y Plaza Dorada, así como tampoco la querella contra Brighton ni las solicitudes de intervención de la sucesión.
El mandamus pide al tribunal que "se expida auto… contra la ARPE, ordenando que cumpla con su deber ministerial de emitir y notificar una resolución sobre la intervención, mas la notificación oficial de cualquier orden, autorización o aprobación de naturaleza alguna que se haya emitido sin notificar oficialmente al demandante en los expedientes de anteproyecto de construcción, y resolución de la querella pendiente de resolver".

La Administración de Reglamentos y Permisos (ARPE) tendrá que acudir ante el juez superior Oscar Dávila Suliveres el próximo 1 de abril para explicar su posición con respecto a los controvertidos desarrollos Brighton Country Club y Plaza Dorada en el municipio de Dorado.
Ese día el Juez Dávila Suliveres presidirá una conferencia con antelación a la vista de entredicho provisional en un recurso de mandamus contra ARPE solicitado por la representación legal de David Efrón y la Sucesión de José Efrón.
Dicho recurso podría representar problemas para Brighton Country Club y Plaza Dorada, dos desarrollos que alegadamente se han estado construyendo en violación a los reglamentos de ARPE y del Departamento de Recursos Naturales y Ambientales (DRNA).
También ARPE, una agencia que en los pasados años ha estado bajo fuego por violentar sus propios reglamentos y que ha tenido que cambiar de liderato en circunstancias poco halagueñas, deberá explicar por qué le ha permitido a Brighton construir prácticamente todo el desarrollo sin los permisos correspondientes y sin escuchar a la Sucesión Efrón, que ha estado intentando reivindicar sus derechos en el caso desde al menos el 2001.
Brighton y Plaza Dorada son dos componentes de un mismo proyecto en el área de Dorado y comparten las obras de urbanización, incluyendo obras para el manejo de las escorrentías de agua causadas por la construcción.
El proyectista resolvió el problema de las escorrentías construyendo dos tuberías ilegales que echaban las aguas hacia terrenos propiedad de la Sucesión Efrón, lo que provocó que el DRNA emitiera una orden de paralización de las obras de drenaje y radicara una querella formal contra Brighton, solicitando multas ascendientes a $250,000. Esa querella está pendiente de adjudicación.
El 20 de junio del 2003 ARPE determinó que Brighton no tenía endosos agenciales para una charca de retención y las obras pluviales del proyecto que, según la agencia, se estaban llevando a cabo sin los permisos correspondientes y en violación a la ley y a los Reglamentos 3 y 12 de Planificación.
En el recurso de mandamus radicado a nombre de Efrón por el ex juez presidente del Tribunal Supremo, José Andreu García, y el Lcdo. Juan R. Marchand, se alega que Brighton ha continuado con la construcción a pesar de las órdenes de paralización y las querellas radicadas en su contra.
Una de las cosas que ARPE tendría que explicar es por qué, a pesar de que la agencia no ha resuelto las solicitudes de intervención radicadas por la sucesión Efrón en el caso, ciertos funcionarios de la agencia se han estado reuniendo en privado con los desarrolladores.

Los sistemas naturales son entes complejos en los que cualquier acción sobre una de sus partes se refleja de alguna forma en todas las restantes. Al estudiarlos se toma en consideración la interacción entre sus componentes y se toman en cuenta los múltiples factores que inciden en ellos. De igual forma debemos ver a Puerto Rico como un sistema integrado con características naturales como agua, terrenos y aire que lo definen y que interactúan constantemente con características sociales y económicas. Es partiendo de esa premisa que podemos establecer una planificación racional y efectiva para el futuro.
La llamada permisología es un componente más dentro del complejo esquema que supone la planificación del país. Los procesos de permisos son un requisito para asegurar que al evaluar las propuestas y proyectos se tomen en consideración y se evalúen los aspectos ambientales y sociales asociados a los mismos. Son una herramienta. Las propuestas ambientales de los partidos políticos deben tener una visión amplia del mejor uso presente y futuro de nuestros recursos suelo y agua. Nos preocupa el enfoque visto hasta el momento en los aspectos procesales y no en el desarrollo de un Plan de Uso de Terrenos que permita la utilización planificada de los recursos y que sea producto de la participación ciudadana.
Propuestas como emitir permisos en una hora, dar prioridad y enfocar la mayoría del esfuerzo gubernamental a la agilización de permisos, presentadas de forma aislada y sin una visión sistemática de la Isla, resultan en esfuerzos improvisados y superficiales que de implantarse harían que nuestra vida de pueblo se torne cada vez más difícil. Tendemos a enfocar en las piezas del rompecabezas y luego nos preguntamos por qué no logramos solucionar los serios problemas que nos aquejan.
En estos momentos se proponen proyectos que impactarían significativamente y de forma irreparable el ambiente y que se ubicarían en terrenos públicos costeros y agrícolas de Puerto Rico. El Proyecto Aguirre, el Centro Turístico del Sur, en Salinas, tendrían un serio impacto en la Reserva de Investigación Estuarina de Jobos, lo cual implicaría la pérdida del subsidio federal en la reserva que la Agencia Nacional de Atmósfera y Oceanografía (NOAA) le asigna anualmente, precisamente por su importancia ecológica y científica. Los terrenos pertenecen a la Autoridad de Tierras.
Los proyectos Costa Serena en Piñones y la Cala Dorada en Dorado, estarían ubicados en la zona marítimo terrestre, la cual pertenece -por definición legal- al pueblo de Puerto Rico. Proyectos como Dos Mares en Luquillo y el propuesto cambio de zonificación de la Laguna Tortuguero en Vega Baja, violan las zonas de barreras costeras. El permitir la construcción en estas zonas, significa que el gobierno no recibirá fondos federales para mitigar los impactos de marejadas, huracanes u otros desastres naturales típicos de la zona costanera. El gobierno y, por ende, nosotros los contribuyentes, debemos entonces asumir el riesgo asociado con estos eventos.
Resulta imposible tomar decisiones racionales sobre la viabilidad de éstos y otros proyectos sin una visión de Puerto Rico que parta de la realidad de nuestros sistemas naturales. No se consideran las necesidades futuras de la Isla y tiende a ignorarse la capacidad real que poseen los sistemas naturales para sostener la vida de sus habitantes. Es preocupante que el gobierno actual carezca de esa visión, pero es alarmante que el discurso escuchado hasta el momento de los candidatos políticos refleje no sólo más de lo mismo, sino una falta de interés y un análisis superficial sobre la planificación de Puerto Rico.

La organización comunitaria, Salvemos Nuestra Playa, Inc., les invita a unirse en una coalición que levantará su voz para reclamar nuestro futuro desarrollo sostenible, ecológico y ambiental en Washington. Nuestro abogado, el Lic. Pedro Saade, en conjunto con su asociado en Washington, el Lic. Jim Dougherty, con frecuencia han representado a sus clientes en Puerto Rico y las Islas Vírgenes, destacándose recientemente su defensa en el caso de "Conservation and Historic Trust" de Vieques donde ganaron una demanda por dos millones de dólares. El Lic. Pedro Sadee, también ha trabajado para la National Wildlife Federation.
Además de invitarlos a unirse les recabamos completen el cuestionario adjunto y lo devuelvan a nuestro apartado postal o por correo electrónico antes de la fecha límite que es el 1 de mayo del presente año.
El Lic. Dougherty estará de visita en nuestra Isla durante el próximo mes y le gustaría reunirse con la mayor cantidad de organizaciones comunitarias y ambientales que sea posible. Estamos planificando reuniones en puntos estratégicos como Dorado, Piñones y Rincón, para la conveniencia de todos. El Sr. Dougherty necesita saber de todos los problemas que nos afectan asociados al desarrollo y ambiente. El se propone radicar una reclamación bajo el Freedom of Information Act en relación al proyecto al que nos oponemos denominado como La Cala Turística de Dorado.
De la misma manera desea presentar nuestras objeciones y razones para objetar a distintos proyectos a través de toda la Isla. Debido a que es un año de elecciones en los Estados Unidos las oportunidades de prevalecer y hacer oir nuestros reclamos son mayores. Debemos aprovecharlas. Contamos con todos ustedes.

La Administración de Reglamentos y Permisos (ARPE) le permitió al fin al Lcdo. David Efrón y a la Sucesión José Efrón intervenir en los casos de los desarrollos Brighton Country Club y Plaza Dorada, a punto de cumplirse un año de haberse solicitado la misma.
Abogados de ARPE le informaron el viernes de esa determinación administrativa al juez superior Oscar Dávila Suliveres, quien tenía ante sí un recurso de mandamus radicado por Efrón para obligar a la agencia a cumplir con su deber ministerial.
Dávila Suliveres dio por adjudicada la controversia ante la determinación de ARPE de aceptar la intervención y la promesa de la agencia de que resolverá en 15 días laborables una querella contra Brighton.
Originalmente, ARPE pidió 40 días para resolver, a lo que el abogado de Efrón, Lcdo. Juan R. Marchand, –quien estuvo acompañado por el ex juez presidente del tribunal Supremo José A. Andreu García–, dijo que aunque se allanaría a la decisión del Tribunal había que recordar que la primera intervención se había radicada hacía un año, sin que ARPE resolviera y mientras tanto, Brighton seguía construyendo.
Marchand dijo que había una orden de paralización a causa de la querella a la que Brighton había hecho caso omiso, y preguntó si la compañía paralizaría los trabajos.
El Lcdo. Felipe Sanabria, abogado de Brighton, insistió, por su parte, que no existe tal querella contra Brighton, sino que se trata de una solicitud de investigación preliminar que hizo ARPE en la que Brighton mostró causa, y que no se ha emitido orden alguna de paralización contra su cliente.
Pero Sanabria se unió a Marchand y Andreu García en el pedido para que ARPE acabe de resolver las controversias que tiene ante sí, diciendo que 40 días era un período de tiempo demasiado largo.
Finalmente, la agencia se allanó a resolver en 15 días laborables.
Efrón había solicitado intervenir en el caso de Brighton el 30 de abril de 2003, y en el de Plaza Dorada el 17 de diciembre de 2003. Brighton y Plaza Dorada son dos componentes de un mismo proyecto en el área de Dorado y comparten las obras para el manejo de las escorrentías de aguas causadas por la construcción.
La queja de Efrón es que los desarrolladores, quienes han construido ya más de 50 lujosas residencias sin tener los permisos para ello, está echando las aguas hacia una propiedad de la Sucesión que colinda con el desarrollo.

Dorado - En solidaridad con las comunidades que protestaron hoy frente al Hotel Dorado Beach, donde se reunió la Asociación de Constructores de Hogares en su asamblea anual, el candidato a la gobernación por nominación directa del partido ambiental Puertorriqueños por Puerto Rico, Rogelio Figueroa, hizo un llamado a los constructores y a la banca hipotecaria a que respondan a los reclamos comunitarios de construir sin destruir el ambiente, privatizar las playas ni marginar las comunidades.
"La Asociación de Constructores de Hogares y la banca hipotecaria insisten en la construcción desparramada de casas unifamiliares en terrenos rurales, la destrucción de montañas y quebradas, la privatización de las playas y la marginación comunitaria como su modo de obtener las mayores ganancias. Esto sin importar el costo social, ambiental o económico de sus actos", indicó Figueroa.
"Ellos saben que estos modelos y practicas de construcción no son apropiados para Puerto Rico pues, crean escasez de agua y tapones, son fuente de descontento ciudadano y contribuyen a la violencia que hoy vivimos. El futuro de la construcción depende de que los reclamos comunitarios se tomen en cuenta y se comience a construir un solo Puerto Rico y no uno de urbanizaciones cerradas que dan la espalda y dejan sin agua a comunidades cercanas."
"El que los políticos de los partidos tradicionales callen ante esta situación no valida estas acciones. Pues callan para no perder las contribuciones políticas y dádivas personales", denunció el líder ambientalista.
El presidente del PPR instó a las comunidades a que no le den su voto a los partidos tradicionales que callan ante la destrucción ambiental, y los exhortó a no caer en el juego político tradicional. "Pues tan pronto las comunidades se organizan, los políticos de los partidos tradicionales, respondiendo a sus contribuyentes, crean algún tipo de distracción o excusa para dividir a la gente. La situación del estatus es la mas usada, pero ya las comunidades no se tragan ese cuento y están manteniéndose unidas." Término diciendo Figueroa.

Varias comunidades y ambientalistas protestaron ayer contra la construcción de megaproyectos residenciales y turísticos en Puerto Rico, frente al hotel Dorado Beach, en Dorado, donde se lleva a cabo la convención anual de la Asociación de Constructores de Hogares.
"Casi todos sus proyectos atentan contra las comunidades. Queremos construir convivencia. Sin embargo, a estos constructores solamente les interesa sus ganancias personales", subrayó en un comunicado Sarah Peisch, portavoz del Centro de Acción Ambiental.
Peisch mencionó los proyectos Marina La Cala, en Dorado, propuesto por Frederic Stubbe, presidente de la Asociación de Constructores de Hogares; y el proyecto PFZ Properties, Inc., en Piñones, propulsado por Joel Katz, vicepresidente de la Asociación.
Dijo que estos megaproyectos "tienen el mismo impacto nefasto por toda la Isla, sea Dorado, en Piñones, en Maunabo, en el Cibuco o en Humacao".
"Exigimos un alto al saqueo de nuestras costas", expresó, por su parte, Alma Cumba, portavoz de Protejamos la Playa Sardinera en Dorado.
